Obligation to continue payment in the case of sickness or pregnancy (Swiss Code of Obligations, Art. 324a)
The employment contract is decisive for continued pay in the case of sickness. Provided that the employment contract or the collective employment contract does not provide for a more favourable regulation, and there is no company or individual sickness daily allowance insurance of the company, which insures at minimum 4/5 of the salary, then the continued pay of the salary in the case of sickness or pregnancy shall be guided by the Berne Scale, the Zurich Scale or the Basel Scale. For information regarding which scale shall apply in your case, please contact the district court for your place of employment.
